Terms and Agreement
By submitting payment, this Membership Agreement when signed by the applicant (if a minor, this should be signed by the applicant’s parent or legal guardian) and accepted by Future Masters Chess Academy LLC, constitutes a binding contract between Future Masters Chess Academy LLC and the individual or entity executing the signature page of this Agreement. Membership rights, privileges and obligations commence when the Agreement is signed by both parties as of payment date.
Any and all membership privileges obtained through this membership agreement may be discontinued at any time with prior notice to member. If there is cost increase during the membership the member will be notified and if the member elects to continue the membership the member will be responsible for the costs incurred upon notice. The Member agrees to meet all membership requirements and will notify Future Masters Chess Academy LLC if any requirements can not be met during the agreement term. In the event Future Masters Chess Academy LLC closes and ceases doing business, the member shall no longer be obligated to make payments under this agreement.
Term and Termination
This agreement shall remain in effect until one or more of the following occur:
• Member fails to meet any requirements of membership.
• Agreement term lapses without further terms or agreements added.
• Company files for bankruptcy or ceases to do business.
No warranties are given or implied by this membership agreement.
Waiver & Release of Liability
I understand that participation in any activity offered at the location where the chess activities occur, International Ballet Academy of Norwell, Inc., aka NEMA and 119 Muller Rd., LLC (“IBA”), have the potential to involve risk of injury.
In consideration for allowing me and/or my child/children to participate, I hereby assume all risks associated with activities offered at IBA and agree to hold them harmless as well as Future Masters Chess Academy LLC, its officers, owner, agents, and employees harmless from any and all liabilities, causes of action, debts, claims or demands of any nature whatsoever in connection with my child’s participation in activities connected with Future Masters Chess Academy LLC. Any recovery against Future Masters Chess Academy LLC shall not exceed the total amount paid by member to Future Masters Chess Academy.
A Member is one who:
1. Adheres to our 8 rules of Core Abilities listed in our program
2. Participates monthly in one of payment plans
3. Understands and complies with the knowledge that my company Future Masters Chess Academy LLC has the full decision and reserves the right to determine if a member is meeting these requirements or not.
The member may cancel this agreement by midnight of the Future Masters Chess Academy LLC’s third business day after the date of this agreement, and such cancellation must be in writing to Future Masters Chess Academy LLC.
Default and Late Payment
Should the member default on any payment obligations as called for in this agreement, the member agrees to pay the entire balance due and agrees to pay allowable interest, and all costs of collection, including but not limited to, collection agency fees, court costs and attorney fees. Should any monthly payment become more than 10 days past due, the member will be charged a late fee to cover additional administrative expenses and other expenses related to obtaining your payment. The member will pay a $20.00 fee for every denial from the bank due to insufficient funds. Notwithstanding any of the foregoing, Future Masters Chess Academy LLC reserves the right to terminate the membership of any member upon failure to submit all applicable payments due.
